I need a formal Legal Opinion Letter (法律意見書) from a qualified legal professional with solid expertise in Hong Kong commercial and financial laws. The purpose is to assess whether a planned business model for a mobile Short-Drama App complies with Hong Kong laws and regulations.
Key Regulatory Focus Areas:
- Hong Kong Pyramid Schemes Prohibition Ordinance (Cap. 617): To assess our multi-tiered affiliate/mentorship subsidy framework and ensure it is fundamentally based on genuine product sales/end-consumer spending rather than recruitment or headhunting.
- Payment Systems and Stored Value Facilities Ordinance (Cap. 621): To verify that our in-app virtual token recharge/purchase mechanics (used exclusively for unlocking content, non-refundable/non-transferable) qualify under the Single-Purpose Token exemption and do not require an SVF license from the HKMA.
