We are a Brazilian e-commerce business, NovaCompra Comércio Digital Ltda., currently facing an urgent legal and commercial issue involving a marketplace platform.
Our seller account has recently been suspended, and approximately R$ 48,000 in pending payments have been withheld due to disputed transactions and chargebacks. Despite our previous attempts to resolve the matter directly with the platform, we have not received a satisfactory explanation or resolution.
We are looking for an experienced Brazilian legal professional specializing in e-commerce, commercial law, consumer protection, and digital business disputes.
### Scope of Work
1. Review existing marketplace agreements, payment records, correspondence, and relevant business documentation.
2. Assess the legal grounds surrounding the account suspension and withheld payments.
3. Prepare a formal legal notification (Notificação Extrajudicial) addressed to the marketplace.
4. Draft a professional legal complaint or appeal requesting an explanation and reconsideration of the suspension.
5. Advise on applicable Brazilian legislation, including the Civil Code, Consumer Protection Code, and relevant e-commerce regulations.
6. Recommend further legal measures if the dispute cannot be resolved through negotiation.
### Requirements
- Must be familiar with Brazilian commercial and digital business law.
- Previous experience handling marketplace or e-commerce disputes.
- Excellent Portuguese legal writing skills.
- Ability to prepare professional legal documentation.
- Strong analytical and advisory skills.
