I am seeking legal guidance regarding an Ontario refund cheque for a little over CAD $3,000 that has become stale-dated.
The refund had previously been approved, and the cheque was issued in August 2024 by a company associated with a condominium development project. I recently requested that the cheque be reissued, but was advised that the company has now been completely closed out and that they are no longer able to issue the refund.
I would like assistance determining:
- Whether the underlying refund/payment obligation remains legally enforceable despite the cheque being stale-dated
- How Ontario's two-year limitation period applies to these particular circumstances, including the appropriate commencement/discovery date
- The company's current legal/corporate status and, if it has been dissolved, whether another party or entity may remain responsible for the outstanding obligation
- The most appropriate recovery options, including pre-litigation steps and, if necessary, Ontario Small Claims Court
Ideal experience:
- Licensed to provide legal services in Ontario, Canada
- Experience with Ontario civil/contract or debt disputes
- Familiarity with Ontario's Limitations Act and corporate dissolution issues
- Experience with Ontario Small Claims Court
- Able to review the relevant cheque and correspondence and provide a practical assessment of recovery options
I am initially looking for an assessment of my legal position and available recovery options. Further representation may be considered if appropriate.
