I am looking for an immigration or residence-law specialist with experience in Italian and EU immigration procedures.
The goal is to understand the best legal and practical route for an EU citizen and a non-EU spouse to establish residence in Italy, while maintaining the ability to travel within Europe.
The general situation is:
- One partner is an EU citizen, currently self-employed / operating a business and not presently registered as a resident in another EU country.
- The other partner is a non-EU citizen.
- We plan to legally marry outside the EU and obtain the necessary legalization/apostille and translations.
- We are considering applying for an Italian family-based Type D visa for the non-EU spouse and then moving to Italy together.
- After arrival, the EU citizen would register residence in Italy, and the spouse would apply for the appropriate residence documentation as a family member of an EU citizen.
- We have not yet decided on the exact city/region in Italy.
We would like a consultation covering:
1. Whether this is the best and most practical route.
2. Whether a Type D visa should be obtained before moving to Italy or whether there are better alternatives.
3. Requirements for the EU citizen to establish residence in Italy as a self-employed person/business owner.
4. Requirements and documents for the non-EU spouse.
