I am an India-based Amazon seller seeking a U.S.-licensed attorney to assist with a copyright-related federal court matter involving my Amazon U.S. seller account.
Due to the confidential nature of the matter, specific case details and documents will only be shared with shortlisted candidates.
Situation
My small Amazon U.S. business has been named as a defendant in a U.S. federal copyright/TRO matter.
The disputed product was listed on Amazon but, according to my records:
It received no orders
No units were sold or shipped
It generated no revenue
The listing has already been removed
The use of the image was inadvertent and the image was sourced as part of a larger wall-art bundle that was represented as available for commercial use
The plaintiff's counsel has indicated that any settlement discussions should be conducted through U.S. legal counsel.
What I Need
I am looking for an attorney who can:
Review the Complaint, TRO, Summons and related documents
Assess my legal position and response deadline
Review the evidence against my seller account
Advise on the implications of the TRO
Communicate with opposing counsel
Explore an early dismissal/settlement
Negotiate the most economical resolution possible
Ideally obtain a release/dismissal of my business from the case
Important Budget Consideration
This is a very small Amazon business, generating less than approximately $300/month in U.S. sales.
Because of the limited size of the business, I cannot afford extensive litigation or a large retainer. I am specifically looking for an attorney who can handle this on a limited-scope or fixed-fee basis, with the primary objective being an efficient settlement/dismissal rather than prolonged litigation.
Ideal Candidate
U.S.-licensed attorney
Experience with copyright/IP litigation
Experience with Amazon/e-commerce seller disputes
Federal court experience
Experience with TROs and/or Schedule A defendants is a strong plus
Strong settlement/negotiation experience
Comfortable working with an international client based in India
Willing to work on a limited-scope/fixed-fee basis
To Apply
Please include:
Your U.S. state(s) of licensure
Years of legal experience
Relevant experience with Amazon seller/copyright/TRO matters
Whether you have handled Schedule A litigation
Whether you can communicate directly with opposing counsel
Your fixed fee or estimated cost for:
Initial document review
Contacting/negotiating with opposing counsel
Attempting to obtain dismissal/settlement
Your availability to begin immediately
Please do not request confidential case information in your proposal. I will provide the case documents privately to shortlisted candidates.
I am looking for someone practical and cost-conscious who can help resolve this matter efficiently rather than turn it into expensive prolonged litigation.
